Eamonn McLaughlin is one half of Housing Rights’s Housing Possession Court Duty Scheme.  Eamonn and his colleague  Maria travel across Northern Ireland offering free representation services to tenants and homeowners who have come to court to deal with mortgage or rent arrears.   Here, Eamonn discusses a recent morning at court when he met Grace, a Housing Executive tenant who’d fallen behind on her rent.

Anti social behaviour is a complex issue and can be difficult to address. Anyone guilty of anti social behaviour can be at risk of losing their tenancy.

Safeguarding tenants from nuisance behaviour is an important responsibility of all social landlords, but it can be difficult for landlords to balance the rights of tenants who are complaining about antisocial neighbours with the landlord’s duties towards vulnerable tenants who may require support.

Social Development Minister, Mervyn Storey MLA, has announced that he is increasing funding to the Mortgage Debt Advice Service, provided by Housing Rights, by 50%.

The increase in funding will enable Housing Rights to provide valuable support to more people who are in mortgage crisis and further help reduce the risk of people facing homelessness and repossession.

Back in August, we brought you news of an important and potentially far reaching decision in one of our legal cases.  The case involved some of our Mortgage Debt Advice Service clients who had taken out Bank of Scotland mortgages.  Bank of Scotland appealed the decision, but has now withdrawn this appeal.

Advisers and solicitors working with rural clients affected by repossession may not be aware of the impact that certain planning clauses may have on their clients’ options.  Permission to build certain rural dwellings may have been granted subject to a clause requiring that the property be occupied by a farmer or farm worker.   This type of clause can help you negotiate with a lender who is threatening legal action to repossess the property.
