Houses in Multiple Occupation subordinate regulations

Housing Rights has responded to the Department for Communities stakeholder communication regarding the new Houses in Multiple Occupation (HMO) regime. The Department has set out draft subordinate regulations to support the new regime, which is scheduled to be introduced from 1 April 2019. Housing Rights welcomes the opportunity to comment upon the draft regulations and Code of Practice for Landlords, which provide clear guidance to Councils and landlords and which contain a range of progressive measures that should assist in enhancing standards within HMOs and protecting occupants within HMOs

Housing Rights has produced a new professional resource on the lawfulness of letting fees within the private rental sector.

Letting fees are additional charges for services included in the routine letting and management of properties. They affect both tenants and landlords in the private rental sector – a sector which is increasing in size on account of a shortage of social housing and barriers to home ownership.

Our helpline has fielded lots of calls in recent weeks relating to unlawful evictions. In many of these cases, the landlord had furnished the tenant with a “licence” agreement, rather than a tenancy agreement. However, the fact that a person’s contract refers to them as a licensee does not override the facts of the matter. If, on investigation, it is established that a tenancy in fact exists the landlord must follow the correct legal process to recover possession of the dwelling.

As social housing becomes more difficult to access, many people who may traditionally have found a home in this sector are turning to the private rented sector for a home. However, some people face barriers in accessing this type of accommodation, not just through affordability pressures, but also due to their age. Our adviser talks through a case where she advocated on behalf of a young woman to enable her to take on a tenancy, despite not yet being 18.

An estimated additional 177,000 properties in England are now subject to mandatory House in Multiple Occupation (HMO) licensing as a result of the changes brought about by the Licensing of Houses in Multiple Occupation (Prescribed Description) (England) Order 2018.

Following a successful pilot Housing Rights has secured a contract to provide a free telephone and email advice service for landlords for the next three years.

Funding for the service, which is provided by the Department for Communities, means landlords can access free confidential advice to help meet their legal requirements.  The “Landlord Advice” service aims to promote a professional and well managed private rented sector that is good for both landlords and tenants.
